Asbestos notifications and licence renewals – important information

It has come to the HSE’s attention when visiting sites throughout the UK that several contractors may have been working on projects the fell beyond the period of their licence expiry and as such The Asbestos Licensing Unit (ALU) has been made aware of occasions where licence holders are attempting to notify asbestos work that either

•  starts beyond the expiry date of their current licence,

or

• continues beyond that date.

Such notifications are invalid and should not be accepted by local offices: licences are granted for a specified period of time and organisations cannot conduct work outwith this period.

The Asbestos Licensing Unit remind Licence holders that they are responsible for ensuring renewal applications are made in a timely manner, in order to ensure minimum disruption to their business. From 1 April 2010 ALU’s standard reminder letters will be sent 3 months before expiry of the licence. Applicants are encouraged to apply as soon as possible after receiving ALU’s reminder letter.

I would also advise any main contractors who are working on longer term Asbestos Removal projects to be prudent and check the expiry dates that are noted on the certificates as they have a duty of care to the client.

I interpret from this advice that if the period of the project goes beyond the expiry date or there is a lapse in the renewal then the Asbestos Licensed Contractor may need to submit an additional notification to the HSE.
